When you ask brokers legal questions, most will wisely say “I can’t answer that question because I am not a lawyer”. Well, I am a lawyer, and I can answer legal questions. You can save money and not hire an attorney, but you might find that you are “in pretty deep” when you were not expecting it. If I am your listing agent, I will be advising you from the beginning.

Often non-standard addendum need to be drafted. Most brokers will wisely say, “I can only fill in standard forms. I can’t draft non-standard MLS documents because I am not a lawyer”. Well, I can prepare non-standard forms. I also help For Sale By Owner FSBOs. If a buyer and seller have found each other without the services of a broker, they can hire me to do escrow setup. I can represent either the buyer or the seller, but not both.

Agents advise sellers to retain an attorney when they expect multiple offers. There are more and more multiple offer deals now days. It makes sense for your listing broker also to be your real estate attorney, with no extra charge for the legal counsel.

 

I have a varied background in real estate law and mortgage law. I ran an escrow department in my law office for twenty years. I ran Deal Mortgage Corporation for four years. I have written, reviewed, escrowed, sold, or closed hundreds of deals.
